In a written decision released by Simon Evans the Traffic Commissioner (TC) for the North West of England, Community Transport for Town and Country has received a formal warning.
The operator received the formal warning on findings under S.17 (3) (a) (aa) and (b) of the Public Passenger Vehicles Act 1981 (the 1981 Act).
The Public Inquiry (PI) called into question concerns around the operator’s good repute, financial standing and professional competence.
The decision weighed all these matters, alongside the major concerns in the case, which included matters of road safety and the protection of fair competition in the industry.
Additionally the TC found there were examples of ineffective management and clear failings in accountability
The TC made the decision to limit the size of the fleet, which reduced from six to four vehicles.
This decision came into effect at 2345hrs on Friday 8 March and will conclude 28 days later, on Friday 5 April at the same time.
This will operate as an effective curtailment of the licence.
In relation to Transport Manager (TM) Patrick Lindley Dawson, the TC found his repute was lost, and subsequently declared him unfit to act as a TM, whereby he was disqualified from holding office as TM indefinitely.
