A number of positive findings helped to balance the TC’s findings of insufficient oversight by the Traffic Manager and director
In her decision for Green Mountain Travel Limited and former Transport Manager Jeffrey Heslop, Deputy Traffic Commissioner for the North East of England Fiona Harrington decided that the operator’s licence be varied such as to reduce the number of vehicles authorised from 11 to 10 from 1 October and to add new undertakings to the licence and to also amend the undertaking attached to the licence in 2017, and found that former Transport Manager’s good repute had been seriously tarnished by his failure to carry out his duties.
Green Mountain Travel Limited is the holder of a standard international licence (PB1087751) authorising the operation of up to 11 vehicles with 10 operator licence discs in issue under the licence at date of Inquiry. Its primary business is the transport of school children and adults under local council contracts.
History
The operator had five instances of previous regulatory intervention by the Traffic Commissioner between 2011 and 2019, including: a formal warning letter in 2011 for exceeding passenger numbers on a PSV; a formal warning letter in 2012 following an unsatisfactory maintenance investigation; a preliminary hearing in 2017 following an unsatisfactory maintenance investigation and ‘S’-marked prohibition notice for defective tyres worn beyond the legal limit on vehicle YN07 EAG whilst transporting school children, leading to a formal warning relying on various additional undertakings; a call to Public Inquiry in 2019 following unsatisfactory maintenance investigations in 2018 and 2019 with two further ‘S’-marked prohibition notices for vehicles NJ63 XSB and NK14 WBJ, resulting in a formal warning and additional licence undertakings; and a formal warning in 2020 relating to the demonstration of financial standing, with further conditions but financial standing subsequently found as met.
