In a written decision by Nick Jones Traffic Commissioner (TC) for Wales, New Adventure Travel Ltd received a formal warning, after it failed to operate a local service that it registered with the TC.
It was found that the operator was operating services outside of the timings registered with the TC under section 26(1)(b) of the Transport Act.
Additionally the TC found that the arrangements for maintaining the vehicles used on the local services were not adequate.
Adverse findings were subsequently made under sections 17(3)(a); 17(3)(aa); and 17(3)(c);and 17(3)(e) of the 1981 Act.
The TC consequently imposed a financial penalty under section 155 of the Transport Act 2000, £150 for each 117 discs authorised, so a total of £17,550 – payable to the Welsh Government within 28 days of receiving the written decision.
The TC however did not make any adverse findings under section 17(3)(e) of the 1981 Act, and was found to continue to satisfy the TC through the requirements relating to financial standing, stable establishment, professional competence and repute.
The new operating centre in Builth Wells was approved, and the TC granted an increase in discs to 150.
Transport Manager Eifion Daniel Clarke retained his repute with a warning, as did Transport Manager Christelle Borchard and Transport Manager Kevyn Jones – the TC also accepted Wayne Cowling as Transport Manager.
