In a written decision by Sarah Bell, Traffic Commissioner for London and South East England, Coach Hire Surrey Ltd and Paul Jones were disqualified from holding or obtaining an Operator’s Licence or being involved in an entity that holds such a licence for a period of 10 years.
It was determined that under Section 17(3)(e) of the Public Passenger Vehicles Act 1981, the Operator no longer met the mandatory requirements under Section 14ZA(2) of the said Act, in relation to good repute, financial standing, and professional competence and accordingly the licence was revoked.
The Traffic Commissioner determined that the operator failed to satisfy her that Paul Jones met the requirement for good repute as per Section 14ZA(3)(a). Mr Jones was ultimately found to not be a credible witness in the written decision.
The Traffic Commissioner noted that she was unable to accept the assertion that there was no intentional attempt to mislead concerning his failure to mention his previous criminal convictions on his application to become Coach Hire Surrey Ltd’s Transport Manager.
Speaking of Paul Jones’s conduct the Traffic Commissioner said: “He has lied glossed and scorned without a hint of embarrassment or contrition including at the hearing.”
The written decision noted that the licence would be revoked with effect from 2345hrs on 28 February 2019.
